SALLY EASTHAM PILATES MEMBERSHIP TERMS AND  CONDITIONS 

1. INTERPRETATION

In the Terms and Conditions the following definitions apply:  

1.1 Member: the person purchasing a membership from the Company. 

1.2 Company: Sally Eastham Pilates  

1.3 Membership: the supply of a monthly rolling Membership  

1.4 Membership Fees: the monthly recurring fees payable or fees paid in full in advance. 

2. MEMBERSHIP

2.1 Subject to condition 2.2 when a person has signed up/joined the membership they agree to the terms and conditions, they become a  Member.  

2.2 Acceptance of a person as a Member is at the absolute discretion of the Company.  

2.3 The Company reserves the right to expel, suspend for a specific period or refuse to renew the  Membership of any Member whose conduct is or may, in the Company’s reasonable opinion, be injurious to  the character of the Company, or which amounts to a breach of the Terms and Conditions, or where such  expulsion is otherwise in the interests of the other Members of the Company. Any Members so expelled will  forthwith cease to be a Member of the Company and will not be entitled any refund for any period during  which the membership is suspended.  

2.4 Classes do not run on a Bank Holiday, you can attend a different class with availability in that week, I also offer free access to the online classes during that time. 

2.5 Each Member must complete a health screening form and declare any physical and/or medical  limitations that may affect their ability to participate. 

2.6 It is the responsibility of the Member to check with their GP or other health care professional as to their  medical readiness to participate. 

2.7 The Company reserves the right to refuse access to classes if the health of a Member may be  endangered. 

3. FEES AND PAYMENT

3.1 The fees for a membership are made in advance.  

3.2 Membership fees must be paid in accordance with the Terms and Conditions irrespective of whether the  Member attends the classes. No refund is given for non-attendance.  

3.3 Any Member, who is paying on a recurring monthly charge, will forfeit their membership and the right to  attend the classes if they fall behind in payment for more than 14 working days.  

3.4 Monthly Payments are calculated based on 43 weeks of the year & then the cost is spread out over 12  months. You are not paying for 9 weeks of the year which covers closures due to holidays. Access to the  OnDemand online classes will be given during these weeks. 

4. REFUNDS AND CANCELLATIONS

4.1 Membership can be cancelled by giving one full calendar months’ notice in writing via email. Once in  receipt the Company will notify the Member of the final payment date.  

4.2 Where notice to cancel the Membership is received outside of condition the Membership will be  terminated one month from the next payment date. The next payment will still be charged and no fees paid  in that time will be refunded.  

4.3 Memberships can be suspended for a maximum of 60 days if serious injury, illness (doctor’s note must  be provided) , redundancy from employment or long term travel (2 months or more) occur.

4.4 No refunds will be made unless Sally Eastham Pilates cancels a class and no acceptable alternative is offered (including an online option) and classes can’t be carried over especially if membership has been cancelled or suspended.  An effort will be made during membership to offer a catch up class at another class if there is availability through the Bee Inclined class swap system or directly through Sally Eastham. 

4.5 Refunds are not payable if Members simply change their mind. 

4.6 Annual memberships are non refundable.

5. 1:1 PRIVATE SESSIONS

5.1 To cancel a session 24 hours notice is required otherwise it will be charged at full rate.

 5.2 When a course of 5 sessions is purchased please notice that the expiry date is 8 weeks from purchase.

6. GENERAL

6.1 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which it  may consider necessary or desirable for the regulation of the affairs of the Company and the conduct of  Members. Any such changes will be notified to Members and, until revoked are and will be binding for  Members. 

6.2 The Terms and Conditions will be governed by the laws of England and subject to the exclusive  jurisdiction of the courts of England and Wales.  

7. PERSONAL BELONGING

7.1 Personal belongings are brought to the Studio at the Member’s own risk, and the Company does not  accept liability for any loss or damage whatsoever to such items.
